Lemire actively supports the Leukemia & Lymphoma Society’s Team in Training, an organization dedicated to funding research for leukemia and lymphoma by inspiring athletes to raise money through participation in endurance sports events. Lemire, training for his third triathlon with the team, has set a goal of raising $1,955.00 before competing in the Olympic distance triathlon in Loveland. The race consists of a .9-mile swim, 30-mile bike ride and a 6.2-mile run.

“At the start of each new season I try to figure out why I do this and why I find raising money for the Leukemia & Lymphoma Society - something that I find I need to do,” writes Lemire on his fundraising site. “I still come back to the fact that if it was me or one of my family sitting in that doctor’s office receiving the diagnosis or sitting in the hospital receiving chemo, I would have some comfort in knowing that there were hoards of strangers out there doing everything they can to help fight these diseases. In a way, I do this because my kids are healthy, but I know there are those out there who are not, and I cannot in my worst imagination think of what it feels like to watch your child suffer and there isn’t anything you can do about it.”

Leyendecker & Lemire Law Firm Announces Four Settlements in IP Infringement, Bankruptcy, Patent and Copyright Disputes

Timely dispute resolution, litigation avoided

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces four critical, recent settlements in favor of its clients. 

Leyendecker & Lemire successfully settled a dispute regarding the ownership of copyrights to advertising collateral in favor of a graphic designer client, in which the client retained ownership of the work product created. In a second IP dispute, the firm successfully settled a copyright dispute concerning the infringement of architectural plans in favor of a client. In this action, the client received a five-figure cash settlement.

“Much of our work involves finding the most expeditious, as well as advantageous, outcome for our clients,” says Peter Lemire, Leyendecker & Lemire co-founder. “We are very pleased, as are our clients, in these particular outcomes. None were arrived at easily, but all were fair, equitable and accomplished in a timely manner.”

The firm also recently successfully settled a bankruptcy adversary action for a creditor client in an action by the bankruptcy trustee, who was attempting to pull back payments made to the client from the debtor.

A fourth resolution eliminated expensive litigation for a client when Leyendecker & Lemire obtained a cash settlement for a client from a manufacturer that was making a knock-off of its design patent-protected product and using a product name that infringed the client’s trademark. The settlement was obtained within a month’s time.

Patentee Leslie Broick (U.S. patent number 8,281,946) has invented a garden hose storage unit in the form of a decorative planter. The invention consists of a hose concealing device adapted to contain and conceal a coiled hose within an inner cavity. The inner cavity resides beneath a planting receptacle, which is equipped with a drainage means that permits water to drain from the planting receptacle rather than accumulating within it. The drainage means is adapted to collect excess water from the planting receptacle and prevent the water from dripping onto or otherwise contaminating the coiled hose.

Patentee Erich Papenfus aka Erich Stone (U.S. patent number 8,269,083) has invented string instrument frets and an associated fret optical apparatus, which is an instrument comprising a body, a neck and a plurality of strings. The neck comprises a first end having a headstock, a fretboard, at least one mineral fret coupled to the fretboard, and a second end one of coupled and integrated to the body. The mineral fret may be generally transparent.

“Crystal Frets is a patented process for giving a guitar amazing tone and improved sustain,” said Papenfus. “By replacing standard metal frets with natural quartz crystal, even less of the string vibration is dissipated. Patentee Matthew Bliss (U.S. patent number D668,174) has patented an ornamental design for a stylized Christmas tree that is remarkable as a piece of art decor and a definitive modern take on the holiday tree. “The tree is easy to put up and take down, and it collapses flat for space saving storage,” said Bliss. In addition to ease of use and storage, Bliss’ stylized Christmas tree is visually stunning. Bliss invented his tree in part to honor his grandfather, Lawrence “Bud” Stoecker, who designed his own version of a decorative Christmas tree in the mid-1960s.             On tap at the party was Peter Lemire’s home-brewed beer: Legally Blond Ale, Boilermaker Extra Special Ale and the piece de resistance - Punitive Damage Autumn Ale (9% ABV). “The place was packed, the food was fantastic and the games and music were all terrific,” said one attendee, who mentioned the “Zombie Zapping Simulator” as a favorite among the firm’s client-designed games provided for guests to experiment with that day.

Moving a Law Office: 
More Than Just Herding Cats

      Some of you may have noticed that our firm has not published a new column in a few weeks now. The reason for this is that we were engaged in a Major Office Move.  You know the kind: anguished over for months, thought about repeatedly at 3 a.m. and again at 6 a.m. and over dinner with your spouse. But our move was inevitable. The firm has grown and along with that, we had outgrown our old office suite in more ways than one. In addition to simply needing much more space, we also wanted to be in offices that better reflected the firm’s character and personality. 
      This is, technically, our third space in the company’s history and we have been able to learn from our past experiences and plan for the future. For example, we learned that as you add attorneys to your staff, those attorneys tend to schedule meetings with clients and prospective clients. Also, if you have multiple meetings back-to-back and your main lobby is the size of a British phone booth, things will get crowded and look like I-25 prior to T-REX. 
      Generally speaking, this is not good for business.
      While I can’t say that moving a law firm, or any business for that matter, is something I would want to do on a regular basis (particularly when it comes to getting employees packed up and ready to go prior to the movers arriving), businesses can seize the move as a great opportunity to reflect upon where they have been and where they are going.
      A few columns ago I talked about the opportunities that spring provides to do some spring cleaning for your business. It was essentially a mini-audit for the business owner to determine if they were covering all the legal details necessary to ensure the vision they have for their company. As we were going through the process of finding new offices, I became aware that the moving process itself forces you to take stock of your company and start thinking about what that company will look like years down the road. 
      Through the myriad of necessary decisions inherent in moving a business — like office location, size, configuration and the type of building finish and personality — you are organically lead to essentially constructing a strategic plan for the length of the term of your lease.
      Where do I want to be located? How many employees do I have now and will have in the future? What does the space say about my company (or does it even matter)? How long do I want the lease to be? What are the main functions of my business and will we be adding any lines of business in the future that might need special accommodations or a special environment?
      It’s easy to consider staying put: but if one thing is certain it is the inevitable, change.
      It’s easy to think of the headaches of moving, but what if, instead, you and your staff spent the time leading up to the move as a fun exercise of strategic planning, goal setting and visionary pursuits that can revitalize your business and possibly open up opportunities that were not perceived before? What inadvertently happens is that you become more in touch with your company’s mission and can therefore take measure of how successful you are in keeping true to that mission.
      Sure: No one necessarily wants to stop and carefully think through the details of a strategic company vision. And the actual act of moving is often painful, much like herding cats.
      But a business move can be cathartic. Furthermore, the momentary pain of moving is temporary, yet the fruits of your labor are everlasting - especially if the new space has a great view, like Leyendecker & Lemire, LLC’s new offices. Peter Lemire Completes Soma 1/2 Ironman,

Raises Funds for Leukemia and Lymphoma Research

Lemire, Esq., completed the Soma Triathlon in Tempe, Arizona, on Sunday, October 23, 2011 and raised $25,000 for leukemia and lymphoma research in the process.

     Lemire served as the (non-fundraising) captain for The Leukemia & Lymphoma Society's (LLS) Rocky Mountain Chapter's Team In Training®. As the captain of his team, Lemire assisted his team's coaches and helped ensure that the fundraiser-team members train and be physically and mentally prepared for the race.

     Created 23 years ago, The Leukemia & Lymphoma Society's (LLS) Team In Training is today the world's largest and most successful endurance sports charity program. Team In Training participants raise money to make a difference for cancer patients and their families, and has to date raised over $1.2 billion to fund lifesaving cancer research.

     "The half Ironman is comprised of a of 1.2 mile swim, 56 mile bike ride and 13.1 mile run," says Lemire. "All of our participants did very well and we are thrilled to be able to contribute to this very worthy and very effective organization.

     "As Team Captain, I was happy to come in at 217th out of 525 males and 244th out of the 717 particpants," he adds. "Our team included participants from the Denver metro area as well as Colorado Springs."

     The Leukemia & Lymphoma Society's Team in Training prepares and supports participants by providing a range of athletic, fund-raising and moral support options. Every four minutes, someone new is diagnosed with blood cancer. Every 10 minutes, someone dies. In exchange for training and support, participants raise money towards cures for blood cancers like leukemia -- the No. 1 disease killer of children -- lymphoma and myeloma.

     "Our law firm and our fellow participants all worked very hard to be able to make a difference for those who rely on The Leukemia & Lymphoma Society while dealing with serious health issues," says Lemire. "Though we all had a wonderful time gearing up for this event, we are very happy to ultimately be able to make a true contribution and give back to a community that is very good to us."
