Leyendecker & Lemire Announces
Two New Patents

Vehicle's air conditioning with the engine off, zipper assembly for warehouse netting are among the new patents

July 16, 2014

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm serving entrepreneurs, individual inventors, and businesses of all sizes, announces three new patentees whose inventions have been successfully commercialized.

Leyendecker & Lemire represented Mark W.Orr of Arvada, Colo., who invented a special zipper assembly for industrial netting. Netting prevents debris from falling from shelving and damaging concrete flooring or inflicting bodily harm on warehouse workers. Lightweight items, such as boxes and paper can get caught by the net and block views. Traditionally, clearing this debris has been an arduous task: The net must be cut, the debris retrieved, and then the net repaired using twine or string. This process can compromise the integrity of the net over time. The zipper assembly created by Orr helps allevitate this issue. The assemby has a row of eyelets on either side, allowing it to be zip-ties to the net webbing. This zipper opens to allow for the safe retrieval of debris, and then securely zipped closed. The patent was issued on April 22.

Jerome Daniels of Elizabeth, Colo., was issued a patent for his invention of a dual-mode automobile air-conditioning system. Typically a car's vapor-compression air-conditioner is driven by an engine-mounted pulley system, or a DC motor powered by an electrical source independent of the engine. Only when the motor is engaged does the air conditioning work. Daniels designed an air-conditioning system that can be used when the car is not in operation. The system is driven by one or more thermal electric cooling (TEC) systems, powered by a DC power source and supplemented by a solar energy grid. This patent was also issued on April 22.

"It's my pleasure to announce these - as well as all of our patentess," says Founding Partner Kurt Leyendecker. "It takes trust and relationship building with our clients to see patents to issuance. We assist and educate our clients throughout the process, and to do that, there has to be trust between us and the client."

Nov. 19, 2013

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces two new patentees whose inventions have been successfully commercialized.

Leyendecker & Lemire represented Evan Vergin, owner of In-Line Archery, who developed a device for bow hunters that keeps arrows secure in most styles of quivers.  The Nock-Line® prevents arrows from rattling and reduces the possibility of the arrows becoming dislodged from the quiver. For more information, visit the website at inlinearchery.com.

The device makes it easier to carry luggage and keeps articles from slipping and sliding.

“Our law firm is pleased to represents innovative clients such as Evan and Jeffrey,” says Founding Partner Kurt Leyendecker. “Their ingenuity has made improvements to the sport of bow hunting, and every day travel. It takes a high level of commitment to turn a novel idea into a useable, commercial product. Leyendecker & Lemire Law Firm Announces
New Patentees

Power controlling device and trailer hitch for bicycles
are among new patents represented
by Leyendecker & Lemire

Oct. 16, 2013

The firm recently represented patentee Andy Middlemiss. The patented device by Middlemiss is for controlling power, and it comprises a power source input, at least one power contact or outlet, a power control relay, a digital signal input port and a digital signal detector. The device controls power from the power source input to at least one power contact or outlet by operation of the power control relay.

Leyendecker & Lemire also recently represented patentee Stephen Rodgers, whose invention comprises a bicycle trailer hitch for use in securing a bicycle trailer to a bicycle. Unlike prior art trailer hitches, the transfer of most of the load between an associated bicycle and an associated bicycle during use does not pass through the bolt/fastener used to couple the bicycle attachment section to the trailer attachment section. Rather, the majority of the load is transferred through a direct connection between the respective sections. Rodgers is the principal of Weehoo Inc., a privately held company in Golden, Colo. For more information about Weehoo, which offers the patented iGo pedal trailer, visit rideweehoo.com/.

“Our law firm is pleased to announce these inventive patents on behalf of our clients,” says Founding Partner Kurt Leyendecker. “The two most important factors to the success of an invention are first, a novel and good idea for an innovative product or process, and second, a high degree of commitment by the inventor. A very high level of commitment can even turn an idea that perhaps isn’t so great into a successful product or process. So if you have the will, the desire and the fortitude to see the process of bringing a new product to market, your ultimate chances of success increase significantly. The actual invention of a new or improved product or process plays a very small part in a product’s ultimate success.”

Leyendecker & Lemire Law Firm Successfully Resolves “Honest Toddler” Trademark Dispute

Leyendecker & Lemire represents author of the “Honest Toddler” blog with respect to its widely publicized trademark dispute
with The Honest Company

Sept. 24, 2013

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces the successful resolution of the “Honest Toddler” trademark dispute.

Leyendecker & Lemire represented Bunmi Laditan, author and creator of the Honest Toddler blog, with respect to its widely publicized trademark dispute with The Honest Company, founded by Jessica Alba, a Golden Globe-nominated actress. The Honest Company provides safe, eco-friendly, affordable products for babies and children.

With more than 265,000 followers, the “Honest Toddler” Twitter feed (@honesttoddler) independently created by Laditan turned into a blog at thehonesttoddler.com and a book, “The Honest Toddler: A Child's Guide to Parenting.” All three outlets—Twitter feed, blog, and book—provide insights for parents via hilarious quips about life from a toddler's perspective. Laditan does not sell baby products through her blog.

After weeks of negotiations, Leyendecker & Lemire were able to resolve the issue to the satisfaction of both sides.  Upon executing the settlement, the parties released this joint statement: “For the past several weeks, you may have watched an unwanted situation unfold between The Honest Company and The Honest Toddler. We have now arrived at an amicable agreement which protects both of our respective business interests today and in the future. We want to thank our communities for your unwavering support and look forward to moving forward and doing what we each do best.”

“These sorts of issues are becoming more and more common,” says Peter C. Lemire, attorney on the Honest Toddler case. “With the advent of the Internet, people and businesses that once probably would have never come in contact with one another are now all of a sudden bumping into each other online.  Trademarks need to be on every business owner’s radar screen no matter how large or small their venture is. Failure to do so can be devastating. While we were able to get a successful resolution in this case, not all business owners are so fortunate.”

Leyendecker & Lemire Client Awarded Favorable Judgment in Landmark Keyword Advertising and Trademark Infringement Case

District Court rejects trademark infringement, unfair competition claim

August 21, 2013

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces that on May 7, 2013, the Federal District Court for the District of Colorado granted a favorable judgment for the firm’s client, in a landmark keyword advertising case involving trademark infringement and unfair competition claims, among others. The case highlights the changing landscape of use of competitors’ trademarks in Google AdWords, website content and online advertising, and the perceived sophistication of today’s internet user.

“What this case and this judgment indicates is that the courts are having to rethink their historical positions on exclusivity of language,” says Leyendecker & Lemire, LLC co-founder Peter Lemire. “The continual evolution of the Internet’s verbal landscape, as well as to what degree a company can ‘own’ keywords and phrases in the 21st century, played into this particular intellectual property case."

“The online world continually changes,” he adds. “The courts have come to realize that and this judgment indicates that they are beginning to react accordingly.”

The Leyendecker & Lemire client defended in the case utilized competitor names as key words and in some cases utilized the competitor’s name in the ad text.

“This decision indicates the law’s changing attitude concerning the sophistication of online consumers,” Lemire adds. “No longer do the courts view online consumers as sheep that need to be protected from confusion regarding the source of a product when utilizing search engines; they recognize that consumers have grown comfortable with keyword advertising and upon being directed to extraneous results, they merely hit the back button on their browser until they find the product they are looking for.”

A founding member of the law firm of Leyendecker & Lemire, LLC, Lemire previously served as in-house counsel to various companies in the Denver Metro area in industries ranging from high tech dot-coms to strategic investment firms specializing in the purchase and sale of distressed commercial debt. Lemire has advised companies on issues such as general corporate and business law, employment law, mergers and acquisitions, contract drafting and negotiation, software licensing, strategic relationships, copyright, trademark and cyber law. He holds a Bachelor of Science in economics and a Bachelor of Arts in political science from Purdue University, a Juris Doctor from the University of Denver College of Law, and an MBA in finance from The University of Denver Daniels College of Business. Lemire is a Member of the Colorado Bar Association, the American Bar Association’s (ABA) Business Law section, the ABA Cyberspace Law and Internet Law Committees as well as the ABA’s subcommittee on Electronic Commerce.

Leyendecker & Lemire Law Firm Announces Client’s Technology Patent

Solution Dynamics, LLC Patents Centralized Refrigeration System

May 23, 2013

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces the firm recently represented patentee Calvin Wohlert of Solution Dynamics, LLC on a patent for a centralized refrigeration system.

Many facilities have their HVAC provided by Rooftop Heating and Cooling Units (RTU’s), which are self-contained units that utilize small air cooled refrigeration systems to provide building air conditioning. These units are easy to install and usually have a lower first cost than more traditional centralized chilled water systems.  The drawback of these units is that they are not as energy efficient, and the maintenance cost is often higher than with centralized systems.  In small facilities these types of units make practical sense; however, larger facilities may have 20 to 50 of these units scattered across their roof with a cumulative cooling capacity in the hundreds of tons.  The Central Direct Expansion (Central DX for short) is an innovative approach which involves the installation of a high efficiency centralized refrigeration system for facilities that have multiple RTU’s.  While RTU’s are often installed as the lowest first cost option, they are not the most energy efficient means of providing facility heating and cooling, and normally have high maintenance costs due to non-serviceable compressors failures.  The conversion of standalone RTUs to a central refrigerant system can have quick paybacks, increased reliability, and significant environmental benefits.

“Central DX is a unique approach to a very common energy inefficiency problem in the commercial building sector,” says Wohlert. “This system takes best practices from the industrial refrigeration sector and applies that to the world of commercial building HVAC to achieve approximately 40 percent to 50 percent energy usage reduction and increased reliability.  It is a win for the facility owners, occupants and the environment.  I am extremely happy with the work done by Leyendecker & Lemire on this patent.”

“Our law firm is pleased to announce this important new energy-saving patent on behalf of our client, Calvin Wohlert,” says Founding Partner Kurt Leyendecker. “His company’s inventions and solutions achieve energy and sustainability goals, and increase profit for other companies.”

Leyendecker & Lemire Law Firm Launches Fundraising Drive for
Leukemia & Lymphoma Society

Team in Training Athlete Peter Lemire to Compete at Loveland Lake to Lake Triathlon to Fundraise for
Leukemia & Lymphoma Society

March 20, 2013

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces that Peter Lemire, Esq. will train and compete in the Loveland Lake to Lake Triathlon on June 22, 2013 to raise money for research into leukemia and lymphoma.

Lemire actively supports the Leukemia & Lymphoma Society’s Team in Training, an organization dedicated to funding research for leukemia and lymphoma by inspiring athletes to raise money through participation in endurance sports events. Lemire, training for his third triathlon with the team, has set a goal of raising $1,955.00 before competing in the Olympic distance triathlon in Loveland. The race consists of a .9-mile swim, 30-mile bike ride and a 6.2-mile run.

“At the start of each new season I try to figure out why I do this and why I find raising money for the Leukemia & Lymphoma Society - something that I find I need to do,” writes Lemire on his fundraising site. “I still come back to the fact that if it was me or one of my family sitting in that doctor’s office receiving the diagnosis or sitting in the hospital receiving chemo, I would have some comfort in knowing that there were hoards of strangers out there doing everything they can to help fight these diseases. March 13, 2013

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces three recent patentees whose inventions include a vitamin supplement hangover remedy, an automatic pill dispensing device and trademarked NeedleView™ endoscopes.

Leyendecker & Lemire represented patentee William Halamicek, a systems analyst at Strategic Products and Services and founder of Hangover Painover LLC, located at 6165 Clearwater Dr. in Loveland, Colo., in patenting a vitamin supplement hangover remedy last month. The cherry-flavored supplement comes in powder form in single-serving packages, can be mixed with water or fruit juice, and works best if taken the night of alcohol consumption, although it can also be taken the following morning.

“Hangover Painover is a great preventative and cure for hangover symptoms,” says Halamicek. “It prevents or lessens headaches, nausea, etc., and lets you function throughout the next day. It is easy to take on the go and is fast acting in any situation.”

Halamicek’s product has been field tested and offers a scientifically balanced, synergistic blend of safe vitamins and nutrients that can be taken before, during, or after drinking. Leyendecker & Lemire is the legal correspondent listed for NeedleView™, a new trademark registered in December 2012 in the category of medical instruments products. The U.S. federal trademark registration was filed for NeedleView by BioVision Technologies, LLC, located at 221 Corporate Circle, Suite H, in Golden, Colo. BioVision Technologies develops and manufactures innovative micro-visualization solutions that enable endoluminal and minimally invasive medical procedures in both human and veterinary medicine. Needleview incorporates a very small high resolution imaging technology; the 18-gauge NeedleView endoscopes are micro-sized, resilient, and can be inserted into small joints with ease. BioVision Technologies has integrated unique imaging technologies and customized micro-endoscope solutions to reduce incision size and speed healing.

Leyendecker & Lemire also represented patentee R/X Automation Solutions, Inc., founded in 2004 with a specific charter to develop automation solutions for the mail order pharmacy industry. R/X Automation Solutions, located at 1830 Boston Avenue, Suite A-B-C in Longmont, Colo., has been granted a patent for a pill dispensing device for use in automated pharmaceutical prescription fulfillment.  The device offers the most accurate and reliable performance in the industry.

The company’s Script Count Tablet & Capsule Dispensing Units are engineered to maximize the accuracy, efficiency and control of tablet and capsule prescription orders dispensed in mail order and central fill pharmacies, reducing the cost per prescription. R/X Automation Solutions’ ScriptPick™ Single Channel Unit-of-Use Dispense & Labeling System is a fully automatic process tool designed to dispense and label high running single item Unit of Use products within the mail order and central fill pharmacy environments. The system will dispense any shape Unit of Use product, label the product and discharge the labeled product into a tote or onto a conveyor. The single channels ScriptPick™ system will dispense and label 600 Unit-Of-Use items per hour.

Leyendecker & Lemire Law Firm Announces Four Settlements in IP Infringement, Bankruptcy, Patent and Copyright Disputes

Timely dispute resolution, litigation avoided

December 19, 2012

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, announces four critical, recent settlements in favor of its clients.

Leyendecker & Lemire successfully settled a dispute regarding the ownership of copyrights to advertising collateral in favor of a graphic designer client, in which the client retained ownership of the work product created. In a second IP dispute, the firm successfully settled a copyright dispute concerning the infringement of architectural plans in favor of a client. In this action, the client received a five-figure cash settlement.

“Much of our work involves finding the most expeditious, as well as advantageous, outcome for our clients,” says Peter Lemire, Leyendecker & Lemire co-founder. “We are very pleased, as are our clients, in these particular outcomes. None were arrived at easily, but all were fair, equitable and accomplished in a timely manner.”

The firm also recently successfully settled a bankruptcy adversary action for a creditor client in an action by the bankruptcy trustee, who was attempting to pull back payments made to the client from the debtor.

A fourth resolution eliminated expensive litigation for a client when Leyendecker & Lemire obtained a cash settlement for a client from a manufacturer that was making a knock-off of its design patent-protected product and using a product name that infringed the client’s trademark. The settlement was obtained within a month’s time.

Specializing in patents, trademarks and related complex civil litigation, Leyendecker & Lemire offers comprehensive legal counsel regarding intellectual property assets, including Internet and cyber law, and protection and profit from trademarks, copyrights and name recognition. Leyendecker & Lemire Law Firm
Announces Clients’ New Patents

Patents Include Garden Hose Storage Unit,
Crystal Frets for Guitars, Stylized Christmas Tree

November 14, 2012

GREENWOOD VILLAGE, Colo. — Leyendecker & Lemire, LLC, an intellectual property and business law firm providing Intellectual Property (IP) and business-related legal services to entrepreneurs, individual inventors, and businesses of all sizes, has announced three recent patentees whose inventions include a garden hose storage unit, a stylized Christmas tree and crystal frets for guitars.

Patentee Leslie Broick (U.S. patent number 8,281,946) has invented a garden hose storage unit in the form of a decorative planter. The invention consists of a hose concealing device adapted to contain and conceal a coiled hose within an inner cavity. The inner cavity resides beneath a planting receptacle, which is equipped with a drainage means that permits water to drain from the planting receptacle rather than accumulating within it. The drainage means is adapted to collect excess water from the planting receptacle and prevent the water from dripping onto or otherwise contaminating the coiled hose.

Patentee Erich Papenfus aka Erich Stone (U.S. patent number 8,269,083) has invented string instrument frets and an associated fret optical apparatus, which is an instrument comprising a body, a neck and a plurality of strings. The neck comprises a first end having a headstock, a fretboard, at least one mineral fret coupled to the fretboard, and a second end one of coupled and integrated to the body. The mineral fret may be generally transparent.

“Crystal Frets is a patented process for giving a guitar amazing tone and improved sustain,” said Papenfus. “By replacing standard metal frets with natural quartz crystal, even less of the string vibration is dissipated. Harder than steel, the natural properties of the quartz allows the string energy to be amplified throughout the body, resulting in a warm, resonant tone and increased sustain.” For more information, visit
http://www.crystalfrets.com/.

Patentee Matthew Bliss (U.S. patent number D668,174) has patented an ornamental design for a stylized Christmas tree that is remarkable as a piece of art decor and a definitive modern take on the holiday tree. “The tree is easy to put up and take down, and it collapses flat for space saving storage,” said Bliss. In addition to ease of use and storage, Bliss’ stylized Christmas tree is visually stunning. Bliss invented his tree in part to honor his grandfather, Lawrence “Bud” Stoecker, who designed his own version of a decorative Christmas tree in the mid-1960s. For more information and to view photos of the holiday tree, visit
http://www.modernchristmastrees.com/.

“Our law firm is very proud and honored to announce these new patents on behalf of our clients,” said Founding Partner Kurt Leyendecker. “Leslie, Erich and Matt are individuals who are representative of the wonderfully creative technological and artistic endeavors going on in our community, and their respective inventions are incredibly valuable to the particular market segment to which each pertains.”

Moving a Law Office:
More Than Just Herding Cats

by Peter C. Lemire, Esq

Some of you may have noticed that our firm has not published a new column in a few weeks now. The reason for this is that we were engaged in a Major Office Move.  You know the kind: anguished over for months, thought about repeatedly at 3 a.m. and again at 6 a.m. and over dinner with your spouse. But our move was inevitable. The firm has grown and along with that, we had outgrown our old office suite in more ways than one. In addition to simply needing much more space, we also wanted to be in offices that better reflected the firm’s character and personality.
This is, technically, our third space in the company’s history and we have been able to learn from our past experiences and plan for the future. For example, we learned that as you add attorneys to your staff, those attorneys tend to schedule meetings with clients and prospective clients. Also, if you have multiple meetings back-to-back and your main lobby is the size of a British phone booth, things will get crowded and look like I-25 prior to T-REX.
Generally speaking, this is not good for business.
While I can’t say that moving a law firm, or any business for that matter, is something I would want to do on a regular basis (particularly when it comes to getting employees packed up and ready to go prior to the movers arriving), businesses can seize the move as a great opportunity to reflect upon where they have been and where they are going.
A few columns ago I talked about the opportunities that spring provides to do some spring cleaning for your business. It was essentially a mini-audit for the business owner to determine if they were covering all the legal details necessary to ensure the vision they have for their company. As we were going through the process of finding new offices, I became aware that the moving process itself forces you to take stock of your company and start thinking about what that company will look like years down the road.
Through the myriad of necessary decisions inherent in moving a business — like office location, size, configuration and the type of building finish and personality — you are organically lead to essentially constructing a strategic plan for the length of the term of your lease.
Where do I want to be located? How many employees do I have now and will have in the future? What does the space say about my company (or does it even matter)? How long do I want the lease to be? What are the main functions of my business and will we be adding any lines of business in the future that might need special accommodations or a special environment?
It’s easy to consider staying put: but if one thing is certain it is the inevitable, change.
It’s easy to think of the headaches of moving, but what if, instead, you and your staff spent the time leading up to the move as a fun exercise of strategic planning, goal setting and visionary pursuits that can revitalize your business and possibly open up opportunities that were not perceived before? What inadvertently happens is that you become more in touch with your company’s mission and can therefore take measure of how successful you are in keeping true to that mission.
Sure: No one necessarily wants to stop and carefully think through the details of a strategic company vision. And the actual act of moving is often painful, much like herding cats.
But a business move can be cathartic. Furthermore, the momentary pain of moving is temporary, yet the fruits of your labor are everlasting - especially if the new space has a great view, like Leyendecker & Lemire, LLC’s new offices. Come see the digs:5460 S. Quebec St., Suite 330, Centennial, Colo., 80111. We make good coffee.

Peter Lemire Completes Soma 1/2 Ironman,

Raises Funds for Leukemia and Lymphoma Research

Centennial, Colo. -- Leyendecker & Lemire, LLC Law Firm, an intellectual property and business law firm dedicated to ensuring the highest quality, full spectrum of Intellectual Property (Patents, Trademarks and Copyrights) and Business-related legal services possible for entrepreneurs, individual inventors, and businesses of all sizes announces that Co-Founding Partner, Peter C. Lemire, Esq., completed the Soma Triathlon in Tempe, Arizona, on Sunday, October 23, 2011 and raised $25,000 for leukemia and lymphoma research in the process.

Lemire served as the (non-fundraising) captain for The Leukemia & Lymphoma Society's (LLS) Rocky Mountain Chapter's Team In Training®. As the captain of his team, Lemire assisted his team's coaches and helped ensure that the fundraiser-team members train and be physically and mentally prepared for the race.

Created 23 years ago, The Leukemia & Lymphoma Society's (LLS) Team In Training is today the world's largest and most successful endurance sports charity program. Team In Training participants raise money to make a difference for cancer patients and their families, and has to date raised over $1.2 billion to fund lifesaving cancer research.

"The half Ironman is comprised of a of 1.2 mile swim, 56 mile bike ride and 13.1 mile run," says Lemire. "All of our participants did very well and we are thrilled to be able to contribute to this very worthy and very effective organization.

"As Team Captain, I was happy to come in at 217th out of 525 males and 244th out of the 717 particpants," he adds. "Our team included participants from the Denver metro area as well as Colorado Springs."

The Leukemia & Lymphoma Society's Team in Training prepares and supports participants by providing a range of athletic, fund-raising and moral support options. Every four minutes, someone new is diagnosed with blood cancer. Every 10 minutes, someone dies. In exchange for training and support, participants raise money towards cures for blood cancers like leukemia -- the No. 1 disease killer of children -- lymphoma and myeloma.

"Our law firm and our fellow participants all worked very hard to be able to make a difference for those who rely on The Leukemia & Lymphoma Society while dealing with serious health issues," says Lemire. "Though we all had a wonderful time gearing up for this event, we are very happy to ultimately be able to make a true contribution and give back to a community that is very good to us."
