E-COMMERCE

E-Commerce plays a huge role to today's economy. An essential underpinning of this economy is the fact that agreements entered to on-line are enforceable. While many people might not give it a second though these days, it wasn't too long ago when there was a lot of uncertainty surrounding e-commerce and e-contracting. In 2000 Congress passed the Electronic Signatures in Global and National Commerce Act (known as "ESIGN"). This act guaranteed the legal effect of contracts that utilized electronic as opposed to ink and paper signatures. Certain contracts (such as real estate contracts) are required by state or federal laws require consumer's to be provided with certain notices in writing. ESIGN made it possible, if consumers choose for them to receive that information electronically. Additionally, it allows for certain record keeping requirements in consumer transactions to be kept electronically.

Realistically, electronic commerce is not much different than regular business relationships. Certain transactions should be governed by written contracts and websites that are interactive should be governed by policies and procedures for the people who visit them. The only real difference is that instead of signing on the dotted line, you now check the box to signify that you agree to be bound by the relevant terms and conditions. Therefore, just a much care should be taken in the e-commerce world as it would be in the brick and mortar world a solid electronic agreement is just as crucial as solid contracts are no traditional economy businesses.
